Tori Elisabeth Photography specializes in wedding and couple photography services. Our offerings include, but are not limited to, engagement sessions, wedding photography, post-production photo editing, and photo delivery. To secure a photography session, clients must complete a booking form and pay a retainer as specified in the service agreement. A 25% non-refundable deposit is required to confirm your booking. This deposit will be applied toward the total cost of the photography services. The remaining balance for services is due 1 week before the scheduled photography session. If full payment is not received by the due date, we reserve the right to cancel the session. All prices for services are listed on our website or provided in the contract. Prices may be subject to change, but any price changes will be communicated before booking.
The client agrees to cooperate with the photographer during the session to ensure the best possible outcome. This includes following any reasonable instructions and respecting the photographer's artistic direction. The client is responsible for ensuring that the photographer has full access to the photography locations and that the location is safe for the photographer and any crew members. The client must have the necessary permissions for the use of any location or property where the photography will take place, and the photographer is not responsible for any issues arising from these permissions. After the session, the photographer will provide the client with the final edited images within the number of weeks specified in the agreement/contract. Delivery times may vary based on the scope of the project. The images will be delivered in high-resolution digital format unless otherwise agreed. Prints or physical products may be offered separately, depending on the package chosen. We will make every effort to ensure the highest quality of images, but we cannot guarantee specific outcomes regarding weather, lighting, or any other environmental factors that may affect the session.
If the client needs to cancel the session, the retainer will be non-refundable. Cancellations must be made in writing and will be acknowledged by us. If the client needs to reschedule the session, we will do our best to accommodate but cannot guarantee availability for the new date. In the unlikely event that we need to cancel the session due to circumstances beyond our control (e.g., illness, emergency), we will provide a full refund of any deposits or payments made by the client. We retain the copyright to all images created during the photography session. The client is granted a non-exclusive license to use the images for personal, non-commercial purposes. The client agrees to allow Tori Elisabeth Photography to use the images for promotional purposes, including but not limited to, the website, social media, and portfolios, unless otherwise agreed upon in writing. Any commercial use of the images (e.g., for advertising, resale) requires prior written consent and may incur additional fees.
We are not liable for any loss or damage to the images, including those lost during transmission or storage. In the case of any major technical failure (e.g., hard drive crash), we will make reasonable efforts to recover the data, but we do not guarantee that all images will be recoverable. Our total liability for any claim arising out of this agreement, whether in contract, tort, or otherwise, is limited to the total amount paid by the client for the services provided. Neither party shall be held liable for any delay or failure to perform its obligations under these Terms and Conditions if such delay or failure is caused by events beyond its reasonable control, including but not limited to natural disasters, illness, accidents, war, or labor disputes. These Terms and Conditions are governed by and construed in accordance with the laws of the State of Idaho. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Idaho. We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page with an updated effective date.
